Copyright laws
• What is protected? What isn’t?
Original artistic creations including music, literature and photography as well as the branding of a company. Copyright does not however cover the rights to an invention or a concept.
• What benefit is there?
The benefits of copyrighting your work are as follows; it stops others from copying your work, selling copies of your work unlawfully along with making an adaptation without your say, so you can keep your artistic integrity
• How is it obtained?
Copyright is obtained as soon as you have recorded your idea in someway you don't have to apply for one, in the UK at least. You are permitted to mark your work using the copyright symbol and a date of publication however it will not change the level of protection copyright has on your work but it will signal to the public that this work is copyrighted and act as a warining.
• How long does it last?
Copyrights generally last for 70 years after either the death of the author/ director or 70 years after it was originally published. Once the copyright has expired anyone can use or copy your work as it enters the public domain meaning they no longer have to receive permission from the copyright owner.
• What is an infringement of Copyright?
An infringement of copyright is any use of a registered copyright without permission of the copyright owner examples of this include using; a proprietary engine, in-game assets and music.
• Can you find an example of an infringement within the Games
Industry?
The largest copyright infringement of recent memory is the case of Palworld and Pokémon, there was quite a large dispute over the infringement of both the designs of the "Pals" and the Pokéball like mechanics used to catch them, resulting in a joint lawsuit from Nintendo and The Pokémon company against Palworld's developers Pocket Pair on the 19th of September 2024. The joint lawsuit required Pocket Pair to pay 15million USD equivalent to Nintendo and The Pokémon Company respectively for the damages caused by patent infringement.
As a company we would avoid all possibilities of infringement by creating original assets by ourselves as well as researching whether or not other companies have developed similar designs in the past to see if we're too close and need to diverge and develop our assets further to set them apart.
